General Terms and Conditions of Business

1. Area of application

1.1 These General Terms and Conditions of Business (hereinafter the ‘Terms’) govern the legal relationships between Tanztheater Wuppertal Pina Bausch GmbH (hereinafter ‘Tanztheater Wuppertal’) and its visitors. By buying an admission ticket or attending a show by Tanztheater Wuppertal you give your agreement to these Terms.

1.2 These Terms apply for shows by Tanztheater Wuppertal on the premises of the Opernhaus Wuppertal. Other arrangements may apply for guest performances by Tanztheater Wuppertal within Germany and abroad.

1.3 Admission tickets for shows by Tanztheater Wuppertal may be purchased in the Internet via independent service providers under their own terms and conditions. In this case, the present Terms apply when you attend the show by Tanztheater Wuppertal.

2. Sale of tickets

2.1 Tickets for shows by Tanztheater Wuppertal are sold on the sales premises of KulturKarte Wuppertal, the advance booking outlets of ADTicket, the Musikhaus Landsiedel-Becker, via the telephone hotline, in the Internet and at the box office on the evening of the performance.

2.2 Due to the great demand, advance bookings may be made for a maximum of only four tickets per performance.

2.3 Online booking commences at 10.00 am on the day on which advance booking begins. Online booking is thereafter available round the clock while the quota of tickets lasts.

2.4 The evening box office normally opens one hour before curtain up, including for matinee shows, and as early as 5.00 pm on Fridays. Advice and booking for that evening’s performance will have priority during this period and are only offered for other performances if frequency at the box office permits.

2.5 MasterCard and VISA are accepted for written advance bookings. For booking in person EC cards and bank and building society (Sparkasse) payment cards are accepted as well.

3. Ticket prices

3.1 Tanztheater Wuppertal sets ticket prices by the type and venue of the show and in accordance with seating plans and price categories. Special prices may apply for selected performances (such as premieres, restagings, revivals or dance operas). Tanztheater Wuppertal accepts no liability for prices charged for tickets by third parties.

3.2 Current ticket prices and prices of tickets for special events are shown in the publications of Tanztheater Wuppertal.

3.3 Reductions on the price of admission may be given only at KulturKarte Wuppertal and only upon presentation of relevant evidence for school students (50% reduction), for students  (40% reduction), trainees, unemployed persons, persons performing military service and holders of a Wuppertal Pass.

3.4 Evidence of entitlement to reductions must be shown when buying tickets and, without being asked, when tickets are being shown at the door. Reduced-price tickets are only valid in combination with relevant proof of entitlement. Visitors who do not show proof of entitlement for reductions at the door may not claim a reduction. The performance may not be entered unless the difference has been paid at the box office.

3.5 Persons accompanying severely disabled persons have free admission if evidence of the necessity for permanent accompaniment is presented in the form of the disabled person’s pass.

3.6 No reduction will be given on tickets after they have been bought and paid for.

4. Advance sales and reservations

4.1 The start of advanced booking for shows by Tanztheater Wuppertal in the Opernhaus Wuppertal is shown in the programme flyer and on the website www.pina-bausch.de. Tanztheater Wuppertal undertakes no guarantee for information provided by third parties in publications such as press and online media.

4.2 Group reservations may be made via KulturKarte Wuppertal (subject to capacity and the size of the group).

4.3 Tickets booked in advance will be held for ten days after receipt of the reservation, but for no more than three days before the start of the show. We reserve the right to change this reservation period. Tickets may be picked up from the box office on the evening only if the tickets have been paid for by the end of the reservation period. Tickets which are not picked up will be forfeit and will not be replaced.

4.4 Tickets which have been reserved but have not yet been paid for must be picked up from the box office by 30 minutes before curtain up. They will no longer be held for you after this time and will not be replaced. You should arrive at the box office early enough to allow for any queuing time.

5. Return and exchange of purchased tickets

5.1 Tickets, including those for groups of visitors, will under no circumstances be accepted back or exchanged once they have been sold. No compensation will be paid for unused tickets.

5.2 No entitlement exists for tickets to be applied to another date in the same show run once they have been bought.

5.3 Changes in the cast, other last-minute changes to the running of the show and the cancellation of the show as a result of force majeure will not establish any right to return tickets.

5.4 If a different work is performed than that advertised when the ticket was bought, purchased tickets may be returned at the evening box office up to the start of the performance. Claims for compensation over and above this are excluded. In particular, expenses of the visitor made in vain, such as travel costs, will not be reimbursed.

5.5 If the performance is cancelled, Tanztheater Wuppertal will endeavour to offer a replacement performance. Should this not be possible, the ticket price will be reimbursed less any advance booking and system fees and the VRR public transport component. Claims for reimbursement must be made in writing to Tanztheater Wuppertal within 14 days of the halting of the performance. Claims will lapse after this.

5.6 If the show is halted prematurely during the performance, reimbursement of the ticket price may only be claimed of the performance has been halted in the first act or, in the case of one-act pieces, in the first half. Requests for reimbursement must be made in writing to Tanztheater Wuppertal within 14 days of the premature halting of the performance. No claims will be entertained for reimbursement over and above this. In particular, expenses of the visitor made in vain, such as travel costs, will not be reimbursed.

6. Loss of tickets

6.1 If you lose your ticket you may obtain a replacement at the box office for a charge of € 3 per print-out if you can prove which ticket you purchased.

6.2 If different visitors present the original ticket and the duplicate replacement for the same seat, the visitor with the original ticket will have priority. In this case, the duplicate does not give the right to another seat. The door staff will not check whether the holder of the original ticket is in lawful possession of it.

7. Resale of tickets

7.1 Commercial or trade resale of tickets for shows by Tanztheater Wuppertal is prohibited. Offering tickets for shows by Tanztheater Wuppertal for commercial or trade resale is likewise prohibited.

7.2 It is not permitted to sell tickets for shows by Tanztheater Wuppertal asking prices which are higher than that printed on the ticket.

7.3 Visitors and third parties are prohibited from offering tickets for shows by Tanztheater Wuppertal for sale on the premises of the Opernhaus Wuppertal.

7.4 A contract penalty of three times the value of the admission price printed on the ticket will be imposed for any culpable infringement of paragraphs 7.1, 7.2 and 7.3.

8. Video and audio recordings

8.1 For copyright reasons, any photography, filming and sound recording of shows by Tanztheater Wuppertal by visitors is prohibited.

8.2 In the event of a culpable infringement of paragraph 8.1, both Tanztheater Wuppertal and third party rights holders reserve the right to seek damages.

8.3 If the prohibition of recording is infringed, staff of Tanztheater Wuppertal and the Opernhaus staff are permitted to demand the surrender of the audio or video recording, to delete it irrevocably and to eject the visitor in question from the building, even before the end of the performance.

8.4 By purchasing tickets for Tanztheater Wuppertal visitors agree that the performances will be recorded by persons entitled to do so. These recordings may be freely used and utilised by Tanztheater Wuppertal.

9. Admission to the performance

9.1 Admittance to shows by Tanztheater Wuppertal is only permitted upon presentation of a valid ticket. Door staff must be shown evidence for reductions for reduced tickets without having to request it.

9.2 Reduced tickets are only valid in combination with the relevant evidence of entitlement. Visitors who do not show proof of entitlement for reductions at the door may not claim a reduction. The performance may not be entered unless the difference has been paid at the box office.

9.3 Under no circumstances does any right exist to be admitted after curtain up. Admission to the auditorium may be permitted by order after consulting the Opernhaus staff, but no right will exist to take the seat which has been reserved.

9.4 If the visitor arrives late, whether through his or her own fault or due to force majeur, there will be no claim for reimbursement of the ticket price.

10. House rules

10.1. Your visit to the Opernhaus Wuppertal is subject to the House Rules (Hausordnung) of the Wuppertaler Bühnen und Sinfonieorchester GmbH (Wuppertal Stage and Symphony Orchestra Company), which are displayed in the building.

10.2 Visitors to the Tanztheater Wuppertal do not have the right to take cameras and recording devices with them into the auditoria. Smartphones must be switched off during performances.

10.3 If visitors disturb or annoy other visitors or disrupt the running of the performance, the disruptive visitors may be ejected from a running performance.

10.4 If a disruption threatens to be imminent, entry to a performance may be refused. In such cases, Tanztheater Wuppertal is not obliged to reimburse ticket prices which have been paid.

10.5 Taking food and drinks into the auditorium is prohibited. This also applies to food and drink purchased during any intervals in the performance.

10.6 Visitors must hand bulky objects in to the cloakroom and may not take them with them into the auditorium.

10.7 Smoking is strictly prohibited on the premises of the Opernhaus Wuppertal.

11. Liability

11.1 Tanztheater Wuppertal accepts no liability for injury or loss and damage to property unless Tanztheater Wuppertal or its legal representatives have acted with intent or gross negligence. If injury, damage or loss is caused through services provided by third parties, only the respective third party service provider will be liable.

12. Entry into force

12.1 These Terms shall enter into force on the day on which they are signed.

13. Amendments or additions

13.1 Should any individual clauses be or become invalid, the contracting partners undertake to replace them with valid provisions which are equivalent to the greatest extent possible from an economic point of view, taking account of the purpose of the contract. This shall not affect the validity of the remainder of the contract.
